What is Worker’s Compensation?

Worker’s Compensation is an insurance that provides injured employees compensation for work-related injuries. Every state has laws requiring employers to provide worker’s compensation insurance to employees. The state of Virginia has the Virginia Worker’s Compensation Act that requires most employers to offer worker’s compensation insurance. Virginia requires employers with more than two full-time or part-time employees to have coverage. 

The County of Accomack offers Worker’s Compensation coverage at no cost to employees.

**If an employee is injured on the job, they may be eligible for worker’s compensation benefits. **

Types of Injuries Covered:

Worker’s Compensation only covers injuries or illnesses caused by an accident that happened while at work or while doing something on behalf of the employer. Under the Virginia Compensation Act injuries must:

  • Have occurred at work or during a work related function.
  • Have been caused by a work activity.
  • Have suddenly happened and not be caused by the misconduct of the employee.
  • Have not happened outside of the employee’s scope of work.

Responsibilities:

1. Employees must notify their employer immediately or as soon as possible of work related illness or injury. If the employee is unable to inform their employer due to severity of injury, their supervisor should notify the employer.

2. The injured employee (or supervisor) must immediately call the Company Nurse Injury Hotline.

3. The Company Nurse will gather patient information and assist with medical treatment.

**If an accident is not reported immediately or as soon as possible, rights to worker’s compensation may be lost. **

Medical Treatment:

If medical attention is required, the County will give the employee a list of authorized Worker's Compensation Panel of Physicians Form for the employee to receive treatment. To view the list, click here.

Employees must choose a physician that is on the authorized list, otherwise the employee may be held responsible for medical expenses. 

Employees must accept medical treatment and keep all appointments with authorized providers to ensure they receive the maximum amount of benefits for worker’s compensation and medical expense payments.
